I would add Attaturk over at Firedog lake has a good primer on Bivens suits. Be sure and read the comments, because while Attaturk suggest Cheney may, as VP, have immunity, others point out that other authorities, including Bork, have concluded the VP does not have the same immunity as a President.

Frankly, I'm delighted by the lawsuit. Especially considering that it's been government policy to viciously attack and destroy any political opponents. They're still going after Dan Rather, too. The vicious bastards should have to face some kind of accounting.
